While the promotion of men taking childcare leave is being promoted, it has become clear that there are various problems that exist when men take childcare leave. However, there are few studies that have analyzed the conflicts that arise in the workplace, including specific conflict situations. In this study, I analyze the logic of how the plaintiff, the defendant, and the court positioned the treatment in the Inamonkai case, a rare case of a man taking childcare leave. As a result, judgments were divided according to whether to emphasize the economic disadvantage caused by non-work or the disadvantage caused by non-work due to childcare leave compared to non-work in other cases. Childcare leave is a right recognized by law, and is a leave of absence arising from an important life event. Therefore, it is important that it be treated in the same way as other cases of non-work in the future.
